AUCTION TERMS AND CONDITIONS

The auction shall be governed by the following terms and conditions:

  1. The Darren Chiacchia Fundraiser Auction will be conducted by Internet bidding at www.trakehners-international.com or mailed-bid:

  2. Bidding closes April 30th, 2008.
  3. Bids must be completed Online by 8 pm (20:00) PST April 30, 2008 or RECEIVED at the address above by end of business day (5pm EST) April 29, 2008 in order to be accepted!
  4. An "AUCTION" LINK will be available at the start of the online auction. It will be posted on the Trakehners International home page and links to TI will be provided by the USEA, Darren Chiacchia’s home page, the Chronicle of the Horse Homepage, and numerous farm home pages throughout North America and Europe. NOTE: Bidding begins 04/24/08 at 5 am pacific standard time and closes 04/30/08 at 8 pm (20:00) pacific standard time.
  5. Photos (where available) will be shown on each item’s web pages.
  6. Descriptions are provided by the individual or organization donating the goods or service.
  7. The entire online auction will run from this site. See winner notification procedure below.
  8. Accurate and complete contact information is required during the online bidding process and will be validated by the Equestrian Aid Foundation Office. Users who submit invalid information will be removed from the auction. Your contact information will remain private and is only available to EAF personnel. For security purposes, your specific IP (Internet Provider) address is recorded with your registration. Specify your name, e-mail address, full address and phone numbers. Once you have registered for the auction, you will be sent a confirmation via email. You may change your password anytime you wish.
  9. Bid Increments – Each item will have a minimum bid price and a minimum bid “raise” amount. Please note minimums prior to bidding.
  10. You will be notified automatically by e-mail when you bid successfully and when you have been outbid.
  11. "Proxy" bidding is NOT available. Please check back often to make sure you win the items you have bid on.
  12. All bids placed are binding. THERE WILL BE NO EXCEPTIONS OR REFUNDS GIVEN. If you don't want to pay for the goods or stallion service, do not bid!

  14. The auction will end at 8:00 p.m. PST (20:00) on April 30th, 2008.
  15. Bids will be verified at the close of the auction prior to a winning bidder notification email being sent to the winner. If a bid is invalidated due to lack of information, the item will go to the next highest bidder.
  16. You will need to pay the Equestrian Aid Foundation. Checks are the preferred method of payment or you may call the EAF Office directly to submit your credit card information. All auctions must be paid by checks or AE/Visa/MC within 24-hours of notification to winning bidder. All payments go to the EAF.
  17. Services and winning items will be awarded / delivered and stallion owners or other donating groups notified of who has won the bid, once payment has been received.
  18. The winning bidder agrees to abide by the terms of the auction contract, and the EAF does not assume liability for any disputes that may arise between the bidder and the stallion owner or other donating organizations/individuals.
  19. Winners may be responsible for shipping and handling charges in addition to their winning bid amount.
  20. The net value of your donation may be tax-deductible and the proper tax reporting and record keeping requirements should be discussed with your tax professional.

ADDITIONAL INFO FOR STALLION SERVICE OFFERINGS:

  1. The stallion services offered in this auction are intended for the 2008 breeding season with carry-over into 2009 only if mare does not settle.
  2. Please check each stallion owner listing closely – some stallions do not offer a live foal guarantee with this auction, while others do.
  3. Bids are binding and cannot be withdrawn. A bidder may bid on any number of stallion services or items, however by placing a bid you are making a legal contract between yourself and the Equestrian Aid Foundation.
  4. Many stallions in the Service Auction will transport semen (see list of stallions). If you are high bidder and choose to breed your mare by TS, be aware of several things:
    • You are responsible for any extra expenses associated with the transportation of semen. Expenses generally range from $100-$350 per shipment and you may be expected to pay a deposit on the container. Ask for fees. Budget for veterinary fees.
    • Be sure to ask the Stallion Owner for their breeding program and schedule before you bid. Some stallion owners only collect certain days of the week, some only a.m. or p.m. Most require a 24-48 hour notice before shipping. Do not expect any stallion owner to ship on short notice
    • Most Important. Make sure your mare is fertile, free of infection (have her cultured while in heat), and that your veterinarian has the experience necessary in equine reproduction.
    • Inability to impregnate a mare is not a reason for refunding of money. You may wish to have a second mare as a backup in case your first mare does not get in foal.
    • The successful bidders are committed to the usual mare care and veterinarian fees and are bound by the breeding contracts for the stallion service they purchase.
  5. The EAF urges bidders to contact the stallion owner and to become familiar with the breeding contract, terms and expenses involved with the stallion services on which they bid. All guarantees are between the individual stallion owner and the purchaser.
  • Please keep in mind that you need to communicate with the stallion manager to make your breeding successful. Some stallions have a show schedule. Don't wait until the day you need semen, but plan ahead and keep them informed.
